The area answers for matters pertaining to public law, especially as concerns contractual relations between the Administration (whether federal, state or municipal) and private sector entities.
Primary assignments undertaken:
• Preparation and revision of administrative agreements of public works, services, supply, concessions, management and other related matters;
• Advice on public biddings, including with respect to sealed-bid tenders, consortium of companies, pre-qualifying procedures, price survey, record information registration, invitation, and assistance with the satisfaction of the requirements established in the call or invitation for tender;
• Advice on international public tenders for foreign companies which intend to participate in projects in Brazil, and provision of full legal support essential for evidencing their authorization for operation in Brazil and demonstration of their existence and standing as a technical, industrial or commercial company;
• Advice on agreements relating to the concession of public utilities, permission of service provision and/or use of public assets;
• Filing of defenses with and administrative appeals to the competent agencies for the purpose of annulling public tenders, and, where necessary, litigation of the matter in court until a final and unappealable decision is handed down;
• Review of actions of intervention in private property, mainly in the case of expropriation to determine the competence of the expropriating body and validity of the expropriatory action taken by it as to deviation of purpose, and the filing, when applicable, of defenses and appeals to assure a fair indemnification; and
• Representation before ministries, state offices and instrumentalities, public companies and regulatory agencies.
